DOT ELD Rule

 

Section 32301(b) of the Commercial Motor Vehicle Safety Enhancement Act, enacted as part of MAP-21, (Pub. L. 112-141, 126 Stat. 405, 786-788, July 6, 2012), mandates the Electronic Logging Device (ELD) Rule. The Rule calls for the Secretary of Transportation to adopt regulations requiring ELD use in commercial motor vehicles involved in interstate commerce, when operated by drivers who are required to keep records of duty status (RODS). As of December 18, 2017, affected commercial transport companies and motor vehicles currently maintaining driving records via paper logs will need to convert to ELDs, devices that will automatically record driving time as opposed to drivers having to maintain logs of their activities in writing. The intended goal of the ELD rule is to decrease fatigued driving by commercial truck drivers, reduce the number of crashes, injuries, and highway fatalities involving commercial trucks and buses.

The ELD Rule includes all technical specifications that ELD providers must follow for their device to be considered a compliant ELD. Executive Order 13693

 

The goal of Executive Order 13693: Planning for Federal Sustainability in the Next Decade is to reduce agency direct greenhouse gas emissions by at least 40 percent over the next decade while at the same time fostering innovation, reducing spending, and strengthening the communities in which Federal facilities operate. The Order reiterates that it continues to be the policy of the United States that agencies shall increase efficiency and improve their environmental performance.

Executive Order 13693 Planning for Federal Sustainability in the Next Decade was published March 2015. Among other requirements, it states that if an agency operates a fleet of 20 vehicles or more, it must deploy telematics at the asset level for all new passenger and light duty vehicles and for medium duty vehicles (where appropriate) no later than 2 years after the date of the order. It further states that agency annual asset level fleet data will be accounted for in a formal agency Fleet Management System and relevant data will be submitted to the Federal Automotive Statistical Tool reporting database.

With respect to GPS tracking and fleet telematics, Executive Order 13693 mandates, as part of this Order, that any agency with a fleet of at least 20 vehicles must:

  • Limit “unnecessary or non-essential vehicles from the agency’s fleet inventory”;

  • Reduce “fleet-wide per-mile greenhouse gas emissions”;

  • Acquire “fleet operational data through deployment of vehicle telematics at a vehicle asset level”;

  • Ensure “agency annual asset-level fleet data is properly and accurately accounted for”; and

  • Planning “zero emission vehicles or plug-in hybrid vehicles and opportunities.”
